Plant variety protection is a form of protection that ensures legal protection for improved plant varieties. Plant variety protection holders have exclusive rights to use the plant variety and to grant rights to third parties to do the same. Plant variety protection holders have exclusive rights to utilise the plant variety, and to grant rights to third parties to do the same. The duration of plant variety protection is 25 years from being granted or 30 years for varieties of grapes and trees.
Drafting plant variety protection applications, which differs from patent protection, is one of SBGK’s special services primarily for plant growers and plant improvers, along with representation for such applications and securing protection based on the international UPOV Convention.
