Our partner, Dr. Enikő Karsay was a guest on Trend FM Monitor Afternoon radio broadcast on December 9, 2021. The main topic of the broadcast was the relationship between artificial intelligence and patents, which is an actual topic by the fact that the U.S. District Court for the Eastern District of Virginia recently upheld the decision of the U.S. Patent and Trademark Office to reject a patent application in which the artificial intelligence "DABUS" was designated as an inventor.
Enikő explained in details the practice of patent offices in different countries as to whether the legal environment allows for a patent to be granted to an artificial intelligence as an inventor. The question goes well beyond patent law and raises a number of other preliminary questions in the area of constitutional law, including whether artificial intelligence should have personality rights. Enikő also mentioned future reforms of EU legislation in the field of artificial intelligence (e.g. The Artificial Intelligence Act Proposal) .
