It is a great honor and an important professional achievement that our partner, Dr. Enikő Karsay, was one of the speakers of the "Annual Conference on EU Copyright Law 2021" organised by the Academy of European Law. This year’s conference, which was held in hybrid form, was attended by several participants from the field of copyright, well-known lawyers, high level experts and prominent figures in academia.
Enikő in her presentation entitled "Invoking copyright in trade mark and design matters" introduced and summarized the relationship between copyright and industrial property rights in particular trademark and design law, in the light of EU case law. In the first part of her presentation, Enikő examined the relationship between copyright and trademark law in the context of trademark cancellation proceedings illustrated by a number of EU case law. In the second part of the presentation, she addressed the issue of the cumulation of industrial property and copyright protection, detailing recent decisions of the Court of Justice of the European Union ('CJEU') on the issue of parallel protection (Cofemel case, Brompton Bicycle case), and in particular how national courts apply the decisions of CJEU in their national proceedings.
The main objective of the Academy of European Law (ERA) is to promote the understanding and best practice of EU law by providing legal practitioners from across Europe with training and a forum for discussion and exchange.
